Oakley, et al. v. Ohio State University Wexner Medical Center – collective action for unpaid overtime (Results are public record)
The Plaintiffs filed suit against OSUWMC, alleging that OSUWMC violated the Fair Labor Standards Act (FLSA) by failing to pay all hourly employees overtime, as a result of a timeclock rounding practice. The lawsuit alleged that the time clocks consistently rounded clock-in and clock-out times in favor of OSUWMC and resulted in unpaid overtime wages for hourly workers. After several years of litigation, the Plaintiffs and Class Counsel settled the case for $4,000,000.00. The proceeds of the settlement were distributed among the Plaintiffs and those hourly employees who received a Notice and Claim Form and decided to opt-in to the lawsuit.
