Pregnancy Discrimination Act

The Pregnancy Discrimination Act was enacted by the Civil Rights Act of 1964 and protects pregnant women from being discriminated against in the workplace.

According to the legislation, “Discrimination on the basis of pregnancy, childbirth, or related medical conditions constitutes unlawful sex discrimination under Title VII.”

It continues, “Women affected by pregnancy or related conditions must be treated in the same manner as other applicants or employees who are similar in their ability or inability to work.”

In summation, employers may not discriminate against women who have become or may become pregnant while employed.

Additionally, employers cannot refuse to hire a woman on the basis of her pregnancy if she is able to adequately perform the job functions. The PDA also protects women from being given unequal pay or benefits due to their pregnancy.

Pregnant employees must be allowed to work if they are able to perform their jobs.  If an employee has been absent from work due to a pregnancy related condition and recovers, her employer may not require her to remain on leave until the baby’s birth.  An employer cannot create a rule that prohibits an employee from returning to work after childbirth.
